My husband lost his job (the main source of income) and I lost mine. Our lender has done nothing to help us and say there is nothing they can do. We really don't want to be here in RI anymore and want to leave the state to move back to upstate NY to be near our family. Our house is worth maybe 94K and we paid 185K for it. We can not afford this loss. We won't even re-coup this in 10 years even if the market comes back. And, we don't want to stay here that long to wait. I'm not putting my life on hold. So, what would you do? Be realistic... and with 2 foreclosures on either side of us, please don't suggest renting our place or short sale, it isn't even an option right now. Some TRUTH would be nice right about now. should we just not pay the mortgage and wait to be evacuated so at least we can take that money and pay off credit and student loans? Or will our credit be in the crapper no matter what? So is Chapter 7 the answer? I'm confused as to what to do when, Foreclosure/Bankruptcy etc.... we will be seeing a lawyer soon though.   • I really feel for the both of you. My hubby & I CAN TOTALLY UNDERSTAND. I won't go into great details - it's not pleasant. Perfect idea to see a lawyer - why not a bankrupt attorney? I think that would be best. All the best to you and hubby!
  • If you can't pay the mortgage payment then i would stay in the house as long as possible. Bankruptcy will be worse on your credit so i would try to take the money that you were making to your mortgage and apply towards saving a little money. Many of the credit card companies will work with you if you are not making any payments and will take 30-60% less than the balance.
  • I understand your position. I am a Mortgage Banker and I hear this type of situation all the time. You are having major "Hardships" in your life right now. Please call your mortgage lender/servicer and see if you qualify for a re-modification. They take basic information over the phone in a calculator to determine your qualifications. This program is called "HASP" the rollout by our wonderful goverment. If not, work out a lower payment schedule with your lender. Many times they will work with you. ***Always pay your MORTGAGE 1st! Also ask if a you can do a "Deed In Leu" with your lender as well, they will discuss your options. Another program is "Cash For Keys" where you surrinder your home, without going through foreclosure. I hope this gives you some ideas and leads you to success.
