In the meantime, you've given your item to the buyer because they gave you the money, but in the end the check comes back as fraudulent and the funds are taken out of your account, and you are out both the money and the item. In some cases, the scammer will, at the last minute, say they need to give you a check for much more than the payment amount, and would you mind cashing the check with your bank and giving them the difference in cash. So in this scenario, you are not only out the payment amount and the item, but also the extra cash you handed over. Never, ever, ever do business by Craigslist with someone who isn't local and can't pay cash.

Technically, you are liable for the money so if you still have possession of the money, then I guess you could be held accountable for it. However, it certianly isn't your fault he's losing your checks. You may want to check with an attorney. Here's how I would handle it: Tell him that you are tired of his poor orginaztional skills screwing up your ability to balance your checkbook and that from now on you will be paying him with money orders. That way if he loses the money order, you've paid him, and the loss is his problem, not yours (as long as you keep your proof of payment). Either that, or see if their is some form of similar payment that your bank can make direct to him that absolves you of liability, IE, some form of electronic payment. Whatever you decide to do, keep careful records, because this guy sounds like an organizational mess, and if you do wind up in a dispute with him, I'm guessing if you have records and he doesn't, you'll win.

I am aware that some people scam with this type of situation, but I will be sure to cash the check and get my money prior to him getting the car. The only concern I have about it at this point is the information he is asking from me. He wants my "full name, address including city state and zip code, my cell phone number, and the total amount of the check." Does this sound legit?   • It is a scam. At some stage he will mention his "shipper" coming to collect the vehicle, and he will include the money for you to forward to his "shipper" once you get the cheque. The cheque will be fake, printed by someone who thinks they have a "work from home" job, usually "employed" by the same scammer to print and mail cheques out.. It can take 6 months for your bank to find out the cheque is fake, at which time, you will have to repay any money drawn on it, and also, you may be charged with presenting a fraudulent cheque.   • I got the same letter and check as the rest of you. The payment center phone number is in Ottawa. I haven't called yet, but this smells like a scam. The area code for the "Stanbee" in Carlstadt, NJ that's on the check is really for Saskatchewan. The satellite google map of the two addresses on the check look like wasteland and a warehouse district. I don't plan to cash the check.

  • I got the same $2700 check from Bank of NY,National Community Division. It cleared and I called their number which they say in around Vancouver. I spoke to three people and each gave a different procedure dealing with a name to send back the money to receive the $75000. One gave a deadline of 8/13 ,another 8/10 I asked each new person the name to send money to and none of them were the same and one said "that person fired", concerning the name the previous person gave. I pressed her and she pawned me to another person who gave yet another new name and procedure. I am reluctant though bank says money cleared.

  • As long as the check does not have "paid as satisfaction in full" or similar language on it and was not accompanied by any letter stating that acceptance of the check constitutes a satisfaction and accord or release you should be able to cash it and still go after them for the rest of the money.
