Frequently asked questions about iowa lending

  • I have a court date tomorrow with a debt collector suing me for a credit card debt that was charged off over 8 years ago. I live in Iowa and the research i found is the the SOL for a written contract is 10 years and unwritten such as open-ended accounts "credit cards" the SOL is 5 years. I have credit reports showing it was charged on in the year 2000. What should i expect, they are suing me for 1500.
  • Credit card debt falls under "Open" contracts, not written...In Iowa this is FIVE years..... These people are playing the default judgement game...they are hoping and praying that you don't show up tomorrow so that they will win by default. No show = default judgement, regardless of the debt being outside the statute of limitations. Be sure to show up!! ========================= Open-ended Accounts: These are revolving lines of credit with varying balances. The best example is a credit card account. Please note: a credit card is ALWAYS an open account. This is established under the Truth-in-Lending Act: In many states, if you have made a recent payment on the debt or if you have acknowledged in writing that you owe the debt, this "can" reset the statute of limitations and the debt collector "may" have a case against you if you have done either of these things. Check out the "Date of Last Activity" on your credit report to see what it says. If you have not done either of this things: --------------------------------- Tell the judge the following: - This is time-barred debt as the statute of limitations has expired Request the following from the debt collector attorney: ***** (Very Important)** DEMAND that the debt collector/attorney furnish a copy of the original signed contract for the defaulted debt. Debt collectors almost never have this and you can use this against them. - Request validation of the original “Date of Delinquency” for this debt - Request validation of the “Date of Last Activity” for this debt ========================= Disclaimer: Be wary of any "free" legal advise you get on the Internet for pending legal proceeding/litigation...it may be blatantly incorrect. The advise I just have is a common defense used to combat debt collectors going after time-barred debt and it "should" be all that you need. Still, you should ideally have an attorney with you.
  • Big John must be a janitor in a law office, because he certainly isn't practicing law in any way, shape, or form. EVERY state has a SOL on debts. Slimick gave good advice. Yes, in some states the law is not very clear and the collection agencies have been able to argue that credit cards are considered written accounts, but those are rather few and Iowa is not one of them to knowledge.
  • You're probably being sued over a "zombie debt". These guys think they can buy an old account, figure they'll take you to court, and force you to pay, believing that you don't know when the SOL is... I'd think this is in small claims then, but explain your case proving the SOL is passed. However, if you made a payment on the account prior to now, the account is "re-aged" and you're screwed (as the SOL clock starts all over again!).
  • Just use the plea of the debt being 'time barred" meaning it is beyond the statute of limitations to seek civil action. If you have any paperwork that shows the last known date of delinquency, bring that with you to prove it is time barred. Also have them provide proof they own the debt, if they are asking far more then what was owed then the following would apply DEMANDING A LARGER PAYMENT THAN IS PERMITTED BY LAW: The FDCPA prohibits debt collectors from misrepresenting the character, amount, or legal status of a debt. The types of complaints that fall in this category include, for example, allegations that a collector is attempting to collect either a debt the consumer does not owe at all or a debt larger than what the consumer actually owes. Section 807(2), 15 U.S.C. § 1692e(2). and please do not believe that answer from the legal expert, that one is way out in left field. Hope this answer is of help to you LEGAL DISCLAIMER: The answer provided here is intended for informational purposes only. • i comprehend people who've been sued and the outcomes. The financial corporation replaced into provided a judgment for the quantity owed, and that they have got been waiting to get the court docket to allow them to attach financial corporation bills and garnishee wages (as much as twenty-5% of internet earnings) to be repaid. this is no longer a place to be in. they could have been plenty greater perfect off negotiating a reimbursement plan with the financial corporation or the collector in the previous allowing it to get that some distance. they only saved ducking the calls and letters and ended up allowing them to stick it to them. They have been shell-taken aback.
  • Wow I wish I had the info that Slimick gave you. I am in NJ & was sued by 2 companies & didn't show up. Both for about $1000. I thought since it's been so long it wouldn't matter. Now they are about to garnish my wages.
  • There is no such thing as a Statue of Limitations on debt or property. Statue of Limitations is for criminal or injury. You should of paid your responsibility in 2000 sorry. I would get to court and make payment arrangements, don't fight it! If you fight it the judge will look at it as you were stealing from the credit card company. You could find yourself in jail. and missed work, fines will make that 1500 dollar got to over 10k fast.
  • Hair Pie Review/Rate this Recipe Save to MyRecipes Rating: Ingredients: 1 1/4 cups rhubarb, sliced into 1/2" pieces 1 cup sugar 1/4 cup water 4 teaspoons cornstarch 1 cup flour 1/4 cup sugar 1 teaspoon baking powder 1/2 teaspoon cinnamon 3 tablespoons butter, softened 1 egg, beaten 3 tablespoons milk Preparation I think the name of this wonderful dessert lends more mystery to it than its actual origin. As any Iowa farm boy could tell you, the hair on a frog is indeed one of Gods finest creations, literally! To put your mind at ease, there is no frog hair in this dessert, but if you look closely at the cooked rhubarb you will notice the fine fibers of the fruit. This appears to be the only explanation for the name that anyone is willing cough up. Preheat your oven to 400 degrees. Combine the rhubarb, sugar. 1/4 cup water and the cornstarch in a large bowl. Stir to dissolve the sugar. Allow to stand for 10 minutes. Pour the mixture in a heavy saucepan and cook over medium heat until thickened. Stir often. Transfer the cooked mixture to a 8X8X2 baking dish and set aside. Combine the flour, sugar, baking powder, and cinnamon in a bowl. Cut in the softened butter with a fork until incorporated. Set aside. Beat together the egg and milk until frothy, and add it to the flour mixture while stirring just enough to moisten. Drop the topping onto the rhubarb mixture creating 6 mounds. Bake for 20-25 minutes until topping is browned.

  • Scarlett Johansson shows up at the Barack Obama campaign rally at the Marriott Hotel in Coralville past Wednesday to lend support to the Democratic presidential hopeful. Scarlett then gave a speech to a group of young voters in a conference room. She then took pictures with Obama’s fans and even drop a few signatures. Perhaps Scarlett’s appearance gave Obama a lift as he won the Iowa Caucuses beating Democratic rival Hillary Clinton.
  • No, celebrities will not be influencing my vote. I am more likely to be influenced by experienced politicians who back the candidates and am most influenced by going on each candidates site to gauge their views and watch them in the debates. In my opinion the "what I'm running on" on each candidates website speaks volumes and so do the answers they provide in the debates. Anyone seeing the debates in Nevada would agree I think as it was fairly clear the democrats had similar fundamental beliefs but there were significant differences that came out. It all depends on which candidate alligns with your beliefs I think. I also think those who are being swayed by supporters may be short changing themselves if they don't get down to the facts. Good luck and be sure to vote!
  • Celebrities have an opposite effect on how I vote. I have more time on my hands to decide which candidate is best. While they gallop around the country and globe making themselves famous. Being influenced by charismatic political characters whilst having a limited grip on the issues can make these "Celebs" dangerous. Don't believe the hype!! many of Hillary's celeb supporters shake hands and have dinner with Castro and Hugo Chavez, This is very telling I think. I won't vote for her!
  • The only way a celebrity could influence my vote is if they were politically savvy like George Clooney. He's very political and knows what's going on in the world. His father Nick Clooney was always very active politically. They care about this country and injustices in the World.
  • Celebrities do not influence my vote. The ones who I'm even aware of are not icons of good sense, nor are they admirable. I think that the amount of attention they get is ridiculous, and does not speak well of us. There are better things to pay attention to than the self centered behavior of people who have too much money, and nothing to do with their time.
  • You see how much trouble the celebrities stay in,how they feel they are above the law.Them supporting a canidate only shows how far from me that canidate is.Friends with Scarlett has nothing to do with running this country.Neither does going to church with Oprah.
  • Generally a celebrity would negatively affect my vote. Most celebrities are not in tune with the average citizen or his/her wants or needs. They live in a superficial world absent the same environment as a normal citizen. Therefore their opinions are not as valid as those of a normal citizen. This is not to say that there aren't SOME celebrities who are aware of the situations of the general population --- just not many.
  • No....Very few celebrities know what it is like to live in the real world. The things that are important to the average American is something they don't comprehend. Really, how many of them have to worry about how they are going to stretch that last 20 bucks to feed their family till payday or the increase in crime in the average neighborhood. They don't have a clue.
  • No it matters not what some celebrity thinks of a candidate. They are only people just like me. I base my vote on what I think and feel about the candidate.
  • The only celebrity that might have an inkling of an effect upon me would have to be highly intelligent, question authority, and speaks his mind. So as of now no, no celebrity has changed my mind. all it would do now is give me a sense of community.
  • If Clooney decided to support Obama then he can forget me ever paying to see anything he produces again! And I would advise others to do the same. Boycott Clooney productions!
  • i think america needs to restore our four iowa class battle ships and lend lease them to israel for a small navy
  • One word: Iraq.
  • You need only ask once.
  • Well, my interest was triggered as a teen growing up on a small farm in Iowa. There were no cabs on the tractors in those days. I seemed to always get caught by a thunderstorm just as far as possible from the house and started reading books on weather forecasting in junior high to get an idea on how I could tell when it was time to head for the barn. That led to chasing storms when I could talk my dad into lending me the old pickup not too long after I got my drivers license. In fact I think the first storm I chased, I only had a permit and dad was with me. When I went into the military I asked to be sent for training in weather and after my discharge got my degree using the GI bill. I often have wondered what my life would have been like in another field and really don't know. I never considered quiting but admit I occasionally get frustrated at times which I think we all do. I still enjoy a day chase once in awhile but don't go out or as far as I did when I was young.
  • I became fascinated in weather while growing up in Oklahoma, a place well known for it's weather. For a while I thought it would be quite difficult to get into forecasting, but after 1 year in college, I decided to not let that get in my way and switched majors. Fortunately getting excellent training and study in meteorology is easy to find in Oklahoma, and now here I am forecasting.
  • Bernie Madoff. Obama's stimulus bills that have no ear marks----well, almost no earmarks. Only about 8,000 in the latest one. Of particular interest to me was the ear mark tor tatoo removal in California. But what if I live in Iowa and I want my tatoo removed at the taxpayers expense? Too bad so sad. Nancy Pelosi's high horse (excuse me I meant to say G5 military jet) at her beck and call and waiting on standby every weekend for her family and friends as well. Banks that secured TARP funds (we thought to start lending money back to the taxpayers who will be paying for those TARP funds) but wait---I guess they decided that the folks in Dubai and China needed it more than us. Is there anyone left who means what they say and says what they mean? Or is it all a bunch of baloney?
  • Were all going down....we need something bigger than a basket !!
  • There is little doubt that the current administration is digging us deeper and deeper int debt. All promises are off. The Republican party needs to get it together and take back a good part of congress in 2010. And then we need a true conservative in the White House in 2012. Without this we may be finished. SFC US Army Retired
  • Country has lost its way and the moral decline is a sign of its impending doom just like all great civilizations before us. By the way don't just parrot what you hear on faux news. The tatoo removal has to do with fighting gangs in calif.
  • I think Obama is doing a great job of getting us out of the hell we have been headed for for the last eight years. It will take some time, but we're going in the right direction.
  • WE ARE ON THE FAST TRACK.
  • Huckabee can better lead the media. That's pretty important, right? They loved running with the term Huckaboom when he won Iowa, and they will love the term Huckabust when he screws up. The name Romney does not lend itself to puns very well, but I think I got off a good one when I said I liked Obama's style and Romney's politics. If they were smushed together I would vote for Obomney.
  • Romney dosnt seem to change his stripes with the landscape like huckabee. If in a fundamentalist atmosphere, huckabee is a preacher, when not in that atmosphere, he becomes a politician. Romney is the same old rich guy no matter where he is, and is at least consistent.
  • You are talking about two entirely different individuals. One is a provincial preacher who evolved to become a politician, with reasonable public speaking skills but otherwise no managerial skills, no international perspective, etc., and a burning desire to rely on "religion" for guidance. The other one is an accomplished business professional, with experience in straightening businesses, building economic value and successfully managing complex situations (Utah Winter Olympics, several business ventures), and a burning desire to rely on facts for guidance. My answer is: if you want a preacher for your church, or a charming leader for your local social club, choose Huckabee. But, if you want a president of the US, willing to confront all critical domestic issues (economy, immigration, etc.) and effectively understand and deal with complex international issues (Iraq war, Israel/Palestine, trade, etc.), choose Romney.
  • I think Huckabee is more likable and down to earth. He is for the common man. Romney just seems fake. He has basically tried to buy the election.
  • Huckabee seems nicer and less arrogant than Romney.
  • Neither are a better leader. In fact, outside of Obama, none of the candidates have shown that they can actually LEAD. It's just parrot-talk to them.
  • Fred!
  • Neither, they both suck and you're not going to win anyway. A democrat is going to win so why bother.
  • Undergraduate programs should include studio art classes (watercolor painting, figure drawing, graphic design), art history, and science (including biology, anatomy, chemistry, physiology, histology). If pursuing a graduate degree in science illustration, the undergraduate program should include foreign language studies and your science courses need to be at a pre-med level. Give consideration to whether the university has a "co-op" program, in which you can gain experience (and college credit) while working within the art community. That will help you to develop your resume. Also give consideration, in your selection of studio art classes, to your portfolio and which classes lend themselves to projects to add to your portfolio. • I consider guys and females say It due to the fact that after Nas recounted It, guys and females that were fans of the Older Rappers realised that the extra up to date rappers dont sound similar to the older ones, they usually additionally say that it may be dead considering now to them plenty of the artists suck considering that they dont have the same sounds that acquired them interested by rap. They see the exchange In Hip Hop. I think the music Is evolving. Whether for the easier or worse it's. I consider that Lil Wayne wouldnt say Hip Hop Is dead considering that due to the fact that the self proclaimed first-class rapper alive that would fu*good enough It up. He could be the high-quality at a vain artwork If it primarily was once as soon as. Game is within the identical factor due to the fact that he needs to develop to be a west coast legend, nevertheless how can you become a legend of an artwork kind thats already dead? I do think it's going to be distinctive if a more youthful man or woman says It considering then individuals wouldnt take It as critical.
  • i dont know of any such institutes but i would suggest just taking a few biology and plant physiology classes and then find someone writing a botany text book you can illustrate for.
  • I just found out I have a simple interest auto loan instead of a compounding interest. The difference is that, no matter how low my balance becomes, I will have to pay $9.52 in interest DAILY until my loan is paid off. This is much different than compound interest where as my balance goes down so does my interest accrued. I feel so bamboozled that I didnt realize this when we signed the loan documents. My auto loan is through santander consumer, I owe $16900 on my 2008 jeep patriot and I have been paying on it for 1 year now and my payments are $440 a month. What are my options? I know I cant refinance because I am very upside down. :( But do I have any other options? I am thinking the only thing I can do is make double payments until my vehicle no longer has negative equity. And then maybe I can trade it in, etc. Please advise.
  • Still got the paper work? Look for the "truth in lending" page. Go to a small local CPA's accounting office and ask them to look at it for you. If they say what you are saying then contact the state's Division of Banking or the Local DA's office because it is illegally high interest. In Iowa they would have to reform from their evil ways. PS Unless that Jeep Patriot has like only 20-30K miles on it you really got taken.

  • Two months ago I was cited for Driving Under Suspension in my native state of Iowa, a charge to which I plead guilty to. Recently however I was able to plead my case to an appellate judge, who rescinded my suspension. So after briefly talking to the court which gave me the Driving under Suspension citation, they recommended I request that the courts re-open my case, but would not give me anymore guidance on how to do that. I am not eligible for a Public Defender and probably cannot afford an attorney, I just need a point in the right direction to make sure I can get the opportunity to show the court these new facts. Any lawyers out there that can lend a hand?
  • What matters is that your license was suspended when you were cited, not that it was unsuspended later--or was it done nunc pro tunc?
  • You would have to file a motion. If you are so inclined, you could research what it would look like at a law library and it should be free to file. (but maybe not) If you plead guilty, you would have to try to move to set aside that plea (with the reasons for your request), enter your different plea, and the court would set it for hearing. Is it really that important? Susp. license is not a murder case. Your life won't change significantly.
  • The judge can only decide on a decision and not guide you on how to proceed. You either hire a lawyer to handle, or go in person to the court clerks office and ask them what forms or papers do you need to re-open your case. Many court clerks are very helpful and can guide you on how to do this. good luck
  • It's tough to say. The South Carolina primary will be important, like it always is in the GOP primary, since it's an early Southern State. I think it largely depends on how the showings of the front-runners coming out of Iowa and New Hampshire are able to parlay their results in South Carolina. I could envision a scenario where Sarah Palin takes it, by having a strong showing in Iowa, skipping New Hampshire, and marking that as a strategic victory going into South Carolina where a win could give her the support needed to start pulling away around Super Tuesday. I could also see it going the complete opposite direction too, with New Hampshire lending credibility to whichever moderate candidate (perhaps Romney or Jindal) performs best in Iowa, then that candidate taking the win down to South Carolina where a 2nd place finish or better puts them into the spotlight and allows for them to start leading in the polls in the more moderate States and take a big super-Tuesday win. I could also see a fight down to the wire with a bitter battle. I could also envision a 3-party race with either a moderate winning in the GOP and Palin running as a Tea Party candidate or with Palin or Romney winning in the GOP and Bloomberg running as an independent (that scenario scares me because it's the only way I could envision Palin actually winning). My serious prediction, though, is that Palin doesn't want to be President for the same reason she didn't want to keep being Governor. There's a lot more money and a lot less pressure in being the king-maker than in being the king. I think she'll appear to be running for as long as she can, then through her massive infrastructure and money behind Mike Huckabee, the most conservative sane candidate who has instant credibility because he stuck around long enough in 2008 to get more delegates than Romney (even though Romney was practically speaking the runner-up, Huckabee refused to concede specifically so he would end up being the technical runner up coming in to 2012, a smart tactic). With Palin's support, I think Huckabee will win the GOP nomination and it will be a tough fight between him and Obama in 2012. I don't know who will win. I like Huckabee personally, but as a politician, he scares me. Better than the guys with no principals, but since I disagree with many of his principals, not that much better.
  • Who do I think it will be? It's way too early to tell who might come out on top of the primaries. But I can tell you who I hope it is: I'm beginning to really favor Allen West. Just look at how he DIRECTLY answers a question that run-of-the-mill politicians kept trying to deflect. http://www.youtube.com/watch?v=TkGQmCZjJ...
