  • I think these guys are reading your question wrong. "..owed 1 payment!"...does that mean you were behind one payment, or that you only had one payment left to finish this all off? I'm gonna bet the first. And if that's the case, there isn't a whole lot you can do. If the take you to court, the will probably win. But you can request that the judge order installment payments.
  • Get a lawyer. If you only had one more payment to pay off the loan, there's something really fishy with this whole thing. There's no way you end up with a $6K balance, even with the fees for repo and auction. Do you have anything in writing that the due date was changed? It sounds like they may have been hitting you with late fees. The new payment goes to the late fees first which makes that payment short and more late fees. This would snowball for two years and leave a big balance due. But somewhere you should have received statements or new coupon books which indicated all those late fees were accumulating.
  • sounds like something isn't right. nobody repos a car with one payment behind. If there is a court hearing coming up, find all the information you can document about your payment record and take that to court with you. It sounds like something went wrong at the finance company to order a repo with only one payment in arrears.
